Clickagy, Clickagy.com and Clickagy, LLC (“Clickagy," “we,” "us," or "our") is a data intelligence company focusing on buyer intent for marketing and analytics purposes primarily in the business-to-business context. This Privacy Policy (the “Policy”) outlines how we collect, use, and maintain personal information in connection with our online services and website (collectively, the “Services”), as well as information on how you can manage the way information about you is handled.

Clickagy offers what is known in the industry as a Demand Side Platform. We provide technology that helps companies manage digital advertising campaigns. We refer to this technology, and additional technologies and services that we provide to our customers and partners, as the “Services” in this Policy.
Digital advertising uses identifiers and related data to help make ads more effective and to measure and report on their effectiveness. As an example, without identifiers, we and our customers would not know whether 100 ad views were the result of 100 different users that each saw an ad, or if one user saw the same ad 100 times.
When we use the term “personal information” in this Policy, we mean any information relating to an identified or identifiable individual, including the identifiers and related data described above.
Our references to the Services in this Policy only refer to Clickagy’s own advertising technology platform and services and do not include the technology or systems of customers or partners that use Clickagy’s Services.

We generally collect information in three ways: (1) you voluntarily provide information to us, (2) we collect information automatically, and (3) other parties may provide information to us.
A. Information You Provide to Us
If you visit our website to fill out a form or otherwise contact us, we will collect the information you provide such as your name and email address, and we will use this information for purposes of fulfilling your request or otherwise responding to you.
B. Information We Automatically Collect
When you interact with the Services, we, our customers, and our third-party service providers (including any third-party content, advertising, and analytics providers) automatically collect certain information from your device or web browser. For example, each time you visit the Services, we and our third-party service providers automatically collect your location, IP address, or other unique identifier, browser and computer type, Internet service provider used, clickstream information, access time, the web page you came from, the URL you go to next, the web page(s) that you access during your visit and your interaction with content or advertising on the Services.
Like many other companies, we collect this information through cookies and similar other technologies, such as pixel tags or web beacons. Below we explain the different types of cookies that may be used on the Services.
Necessary Cookies. Necessary cookies help make a website usable by enabling basic functions like page navigation and access to secure areas of the website. Disabling these Cookies may make the website services and features unavailable.
Analytics Cookies. These cookies are used to collect information about traffic to our Services and how users use our Services. The information gathered is aggregated and does not, on its own, identify any individual visitor. It includes the number of visitors to our Services, the websites that referred them to our Services, the pages that they visited on our Services, what time of day they visited our Services, whether they have visited our Services before, and other similar information. We use this information to help operate our Services more efficiently, to gather broad demographic information and to monitor the level of activity on our Services.
Marketing Cookies. Marketing cookies are used to show our users advertisements across websites such as those on Facebook, LinkedIn, or other sites. The intention is to display ads that are relevant and engaging for the individual user and thereby more valuable for publishers and third-party advertisers.
Third-Party Cookies. Some of our service providers and other third parties may also use cookies and web beacons in connection with the services they perform. The use of cookies by other third parties is not covered by our Privacy Policy. Third parties use session ID cookies to make it easier for you to navigate websites related to our Services. We use third-party services to provide the necessary hardware, software, networking, storage, and related technology required to run and improve our Services. Our third-party partners may employ web beacons to track online user movement to better understand what content is effective. Web beacons are tiny graphics with a unique identifier that are embedded in websites and in newsletter emails. With web beacons, our third-party partners may collect information about you, such as your IP address, your browser or email client type, and other similar details. We use the data from our third-party partners to improve our services. Like these other parties, we also use third-party cookies on other websites associated with the Services for purposes including understanding website visitors’ interests and identifying visitors to the websites of our customers, affiliates, affiliates’ customers, partners, and partners’ customers.
C. Information We Receive from Others
We may supplement the information we collect with outside records in order to learn more about users; to diagnose problems with our servers and software; to administer the Services; to identify visitors to our customers’, partners’, and partners’ customers’ websites; to perform behavioral and targeted advertising; to gather demographic information; and for other purposes. We receive this information from third parties, including without limitation our customers, businesses we affiliate with, data resellers, our partners (including advertising and analytics partners), public sources, and social networks. For example, our third-party advertising networks and ad servers provide us with information, including reports that will tell us how many ads were presented and clicked on through the Services. To the extent authorized by applicable laws, we combine the information we receive from those other sources with information we collect through the Services.
We use the information we collect for purposes related to targeting, delivering, measuring, and reporting on advertising, as well as gathering information relevant to marketing and analytics, more generally:
Personalizing ads: We use data to increase advertising relevancy and effectiveness.
Ad delivery: We use data to enable the technical delivery of an ad and measure success of delivery.
Frequency and other reporting: We use data to keep track of how many times an ad was shown, as well as where and when.
Measurement and analytics: We use data to measure how well ads perform, such as whether users clicked on the ad or went to a customer’s site after their ad campaign was shown.
Reporting: We use data to measure, attribute, and report on the performance and success of campaigns, including, in some cases, reporting with respect to personas or identifiable individuals.
Clicks and conversions: We may use data to measure actions taken by a user with respect to a particular ad, i.e., a click on an ad, or a download of an app, and we may map this information to personas or to identifiable individuals.
Attribution: We may use data to match particular ad views to subsequent actions taken by a user. For example, a security company might be able to see that someone who saw an ad for security software subsequently purchased the software. This would be done by stitching together the identifiers from the sites where the ad was served and where the online purchase was made.
Buyer Intent: We use data to match devices and the people or companies associated with the devices to topics associated with the web pages they visit. We do this by using natural language processing or similar automated content analysis to determine in real-time the topics corresponding to the web content of the visited page. We use this buyer intent information for our and our customers’, affiliates’, affiliates’ customers’, partners’, and partners’ customers’ marketing, research, business development, and related purposes.
Website Visitor Identification: We use data to specifically identify the visitors to websites operated by our affiliates and affiliates’ customers, such as by linking browsing data or identifiers to other data points associated with an individual.
Cross device graphing: We may use data to associate pseudonymous and other identifiers that might be related to each other. Such a graph might link various identifiers present on a single device, various identifiers associated with an individual who has multiple devices, or multiple devices/individuals within the same company or organization.
Detection of malicious or invalid activity: We process information in an attempt to prevent malicious activity, invalid ad traffic, or otherwise fraudulent or deceptive traffic. This may include identifying and preventing purveyors of malware or bots that try to take advertising dollars for ads that aren’t shown to real users, that try to harm users’ devices, or that otherwise act in a fraudulent or harmful manner on the Services.
In addition to the uses described above and in other Sections of this Policy, we may also use the information we collect in the following ways:
To develop, provide, maintain, personalize, and improve our Services;
To verify, cleanse, update, and maintain information used in our Services;
To process user and customer transactions;
To send technical notices, updates, security alerts, and administrative messages;
To communicate with you, respond to your requests or feedback, or provide you with updates, information and support;
To create and maintain customer and user accounts and authenticate users;
To better understand our users, their interests, and their preferences;
To monitor and analyze trends, usage, and activities related to the Services;

To personalize your experience, save your preferences, authenticate our users, and provide similar user-experience features;

To respond to requests from individuals to exercise their rights related to their information under applicable law;
To comply with our contractual and legal obligations, resolve disputes with users, and enforce our agreements; and

We may share information with our customers and partners, including marketing partners.
We may share information with our affiliates who may act for us for any of the purposes set out in this Policy, including our current and future parents, subsidiaries, and other companies under common ownership and control with Clickagy.
We may share information with our service providers who provide functions related to our operation and provision of the Services.
We may share information as required by law and when we believe that disclosure is necessary to (a) protect our rights, (b) comply with a judicial proceeding, court order, or legal process served on our Services, and (c) respond to data subject requests to the extent necessary to comply with applicable laws.
We also reserve the right to transfer information about you to a successor organization if we transfer the ownership or operation of one of our websites to another organization or if we merge with another organization. Following such a sale or transfer, you may contact the entity to which we transferred your information with any inquiries concerning the processing of that information.
The Services are operated in the United States. If you are located in another jurisdiction, please be aware that information you provide to us will be transferred to, stored, and processed in the United States, which may have different privacy laws from your country of residence.
Clickagy is committed to protect the security of its users’ data and information and will take necessary steps to assure data and information security. We use a variety of industry standard security measures, including sophisticated encryption and authentication tools, password protection, and restricted permissions, to maintain the safety of your personal information from accidental loss, unauthorized access, use or disclosure. Regardless of these efforts, no data transmission over the Internet can be guaranteed to be 100% secure.
Clickagy will retain personal information for a period of time consistent with the original purpose(s) for which we collected it, as described in this Privacy Policy, including, as applicable, (i) for as long as we have an ongoing relationship with the individual to whom the information pertains; (ii) as long as needed to provide users, our customers, or our partners the Services; (iii) as necessary to comply with our legal obligation(s); (iv) as necessary to resolve disputes or to protect ourselves from potential future disputes; or (v) as necessary to enforce our agreements. Retention periods will be determined taking into account the amount, nature, and sensitivity of the personal information and the purpose(s) for which it was collected. Information collected through your interaction with our Services is often aggregated or deleted within 30-60 days, but may be retained for 13 months or more from the date of collection before aggregation or deletion.
As detailed above, we and some of our service providers or other third parties use certain online tracking technologies to collect personal and other information. You may opt out of being tracked by these technologies manually by clicking the “Submit” button on the deletion request page of our Privacy Center here. This action will need to be taken on each device or browser you wish to be opted out on, and it will need to be repeated if you clear the cookies from a device or browser. You may also opt out by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC) on the browsers and/or browser extensions that support such a signal. Clickagy does not knowingly collect or use personal information from a user known to be a minor. If we learn that we have collected information from a minor, we will take steps to delete the information as soon as possible. We may provide links to or embed videos hosted by third-party websites, services, and applications that are not operated or controlled by us. This Policy does not apply to third-party services, and we cannot take responsibility for the content, privacy policies, or practices of third-party services. We encourage you to review the privacy policies of any third-party service before providing any information to or through them.
A. Networking Advertising Initiative
The Network Advertising Initiative (NAI) is a coalition of online advertising companies committed to complying with self-regulatory standards that establish responsible business and data management practices. Clickagy is a participating member of NAI and is compliant with NAI self-regulatory principles.
B. DAA Membership
Clickagy is also a participant in the Digital Advertising Alliance’s (DAA) Self-Regulatory Program for Online Behavioral Advertising and follows the DAA’s Self-Regulatory Principles for Online Behavioral Advertising. The DAA also provides a global opt-out feature, available here, that lets users choose not to receive cookies from companies that are DAA members.
C. IAB Europe
Clickagy participates in the IAB Europe Transparency & Consent Framework and complies with its Specifications and Policies. Clickagy’s identification number within the Framework is 1222.
GDPR and lawful basis: Clickagy endeavors to comply with the provisions of the General Data Protection Regulation (“GDPR”) as to any information in its possession regarding EEA-, UK-, and Switzerland-based persons (“data subjects”). As such, Clickagy only processes personal information on data subjects where it has a lawful basis to do so. In most cases, this lawful basis will be consent. We may also rely on the lawful bases of performance of a contract, compliance with a legal obligation, or the legitimate interest of Clickagy or a third party. Under the GDPR, the processing we engage in is as a controller of personal data in some cases, and in some cases as a processor. Clickagy acts as a controller, for example, when it identifies and segments audiences based on digital behavioral data. Clickagy often acts as a processor on behalf of its customers, who are also responsible for handling data subject rights requests under the GDPR and other applicable laws. Clickagy’s obligations with respect to personal information for which we are solely a data processor are defined in our agreements with our customers and are not covered by this Policy.
Right to lodge a complaint: Data subjects have the right to lodge a complaint about our data collection and processing actions with the supervisory authority concerned. Contact details for data protection authorities are available here.
Transfers: As noted in Section V above, personal information we collect may be transferred to, and stored and processed in, the United States. Where required by the GDPR, we will ensure that transfers of data subjects’ personal information to a third country or an international organization are subject to appropriate safeguards as described in Article 46 of the GDPR, such as the UK or EU Standard Contractual Clauses, as applicable.
Individual rights: Residents of the EEA, the UK, or Switzerland are entitled to the following rights under the GDPR:
Rights to access, correction, and restriction of processing. Individuals have the right to request access to, and a copy of, their personal information at no charge, as well as certain information about our processing activities with respect to their data. Individuals have the right to request correction or completion of their personal information if it is inaccurate or incomplete. Individuals have the right to restrict our processing if they contest the accuracy of the data we hold about them, for as long as it takes to verify its accuracy.
Right to request data erasure. Individuals have the right to have their data erased from our Site if the data is no longer necessary for the purpose for which it was collected, they withdraw consent and no other legal basis for processing exists, or their fundamental rights to data privacy and protection outweigh our legitimate interest in continuing the processing.
Right to object to our processing. Individuals have the right to object to our processing if we are processing data based on legitimate interests or the performance of a task in the public interest as an exercise of official authority (including profiling); using data for direct marketing (including profiling); or processing data for purposes of scientific or historical research and statistics.
Right to data portability. Under some circumstances, individuals have the right to ask for a copy of their data in a machine-readable format. Individuals can also request that we transmit their data to another entity where technically feasible.

If we make any changes to this Policy that materially affect our practices with regard to the personal information we have previously collected from or about you, we will endeavor to provide you with notice in advance of such change by highlighting the change on our Services or providing notice pursuant to the provision of our Services, but we make no guarantee as to such advance notice. Right to Correct: You have the right to request that we correct inaccurate Personal Information about you, taking into account the nature of the information and the purposes for which it is processed. Because the CCPA permits deletion in lieu of correction where deletion does not negatively affect the consumer, Clickagy may process requests to correct as requests to delete. You may contact us as directed below if you believe such deletion would negatively affect you.

Consumers may make a request pursuant to their “right to know/access”, “right to correct,” “right to request deletion”, and/or “right to opt-out” under the CCPA or other State Privacy Laws by visiting our Privacy Center page on our Website. Requests may also be made by contacting us at privacy@clickagy.com, or by calling (833) 737-1973, but technological reasons may require use of the webforms to action some requests. Requests will need to be made for each device or browser you wish to include in the request (e.g., to opt out multiple devices or browsers, you will need to visit the opt-out page from each such device or browser). In order to verify your request to access or delete information, we may require you to take certain actions, such as filling in our webform here, or to provide us with certain information to be used solely for the purpose of verifying your identity. Typically, the information you will need to submit for this purpose will include either your cookie ID or your mobile ad ID, although it may be necessary in some cases to provide a different piece of information. In all cases, we will use commercially reasonable means to verify your identity in order to safeguard your Personal Information and that of other consumers.
Under the CCPA and some other State Privacy Laws, you may exercise these rights yourself or you may designate an authorized agent to make these requests on your behalf. We may request that your authorized agent have written permission from you to make requests on your behalf and we may need to verify your authorized agent’s identity using commercially reasonable means.
We endeavor to respond to a verifiable consumer request within 45 days of its receipt, or a shorter or longer timeframe as required by the applicable State Privacy Law. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt unless another applicable period applies. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will choose a format to provide the Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to a consumer’s verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing the request.
