This Privacy Statement for Residents of Specified States (“Privacy Statement” or “Statement”) supplements the information contained in the Clickagy Privacy Policy. Clickagy has adopted this Statement to comply with the state laws specified below, and it applies solely to “consumers” as that term is defined in each respective state law. When used in this Privacy Statement or in our Privacy Policy, any terms defined in these state laws have the meaning given to them by those laws with respect to such state’s consumers. Capitalized terms used but not defined in this Privacy Statement have the meaning given to them in the Clickagy Privacy Policy.
Clickagy is committed to protecting the privacy of California residents under the California Consumer Privacy Act, as amended (CCPA), and other California privacy laws, as well as the privacy of residents of other states that have adopted privacy laws. This Statement provides additional details about the Personal Information Clickagy collects about consumers in states with privacy laws and the rights they have under those laws. As a general matter, this Statement focuses on the rights granted to California residents under the CCPA, and differing rights related to other State Privacy Laws are noted where relevant. When we say “Personal Information” in this Privacy Statement or with regard to the Personal Information of a California resident, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household. Personal Information does not include information that is aggregated or information that cannot be reasonably linked to you. We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing prior notice.
To the extent that the rights afforded under a specific State Privacy Law may apply to the Services or otherwise differ from rights afforded under the CCPA, they are indicated throughout this Privacy Statement by way of an 🡪 Other State Laws heading. Please note that, under other State Privacy Laws outside of California, these rights generally do not apply to residents acting in a commercial or employment context, but may apply where they are acting in an individual or household context.

To the extent the CCPA requires that these details be reported with reference to specific categories, in the last twelve (12) months, we may have collected the following categories of Personal Information:

Right to Correct: You have the right to request that we correct inaccurate Personal Information about you, taking into account the nature of the information and the purposes for which it is processed. Because the CCPA permits deletion in lieu of correction where deletion does not negatively affect the consumer, Clickagy may process requests to correct as requests to delete. You may contact us as directed below if you believe such deletion would negatively affect you.

Consumers may make a request pursuant to their “right to know/access”, “right to correct,” “right to request deletion”, and/or “right to opt-out” under the CCPA or other State Privacy Laws by visiting our Privacy Center page on our Website. Requests may also be made by contacting us at privacy@clickagy.com, or by calling (833) 737-1973, but technological reasons may require use of the webforms to action some requests. Requests will need to be made for each device or browser you wish to include in the request (e.g., to opt out multiple devices or browsers, you will need to visit the opt-out page from each such device or browser). In order to verify your request to access or delete information, we may require you to take certain actions, such as filling in our webform here, or to provide us with certain information to be used solely for the purpose of verifying your identity. Typically, the information you will need to submit for this purpose will include either your cookie ID or your mobile ad ID, although it may be necessary in some cases to provide a different piece of information. In all cases, we will use commercially reasonable means to verify your identity in order to safeguard your Personal Information and that of other consumers.
Under the CCPA and some other State Privacy Laws, you may exercise these rights yourself or you may designate an authorized agent to make these requests on your behalf. We may request that your authorized agent have written permission from you to make requests on your behalf and we may need to verify your authorized agent’s identity using commercially reasonable means.
We endeavor to respond to a verifiable consumer request within 45 days of its receipt, or a shorter or longer timeframe as required by the applicable State Privacy Law. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt unless another applicable period applies. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will choose a format to provide the Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to a consumer’s verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing the request.
